It is expected that the life expectancy of the world will increase and will be 72.6 for 2019 and 77.1 for 2050. InTurkey, the proportion of the population aged 65 and over is projected to be 10.2% in 2023, 16.3% in 2040 and 22.6% in 2060. For this reason, the procedures for the 65 and older group are of great importance. For persons over 65 years of age, a health report (concerning mental faculties) is routinely requested from the relevant departments (notary, landregistry) for legal procedures. For these reports, these individuals first apply to family health centers which are the gateways to the health system. Physicians have been given the authority and responsibilities to issue a health report. Requesting a health report for legal procedures from all individuals over the age of 65 is an application that violates the autonomy of the person and leads to questioning his / her competence and may cause negative consequences. This situation increases the workload of the family physicians and other specialist physicians with a high work load and creates economic burden on the state. There is no mandatory health report issued by the legislation in order to carry out legal procedures for people aged 65 years and over. However, this report is still routinely requested from geriatric individuals. It is of great importance for the Ministry of Health and the Ministry of Justice to provide training to notaries and land registry offices, develop guidelines and impose sanctions.
Dünyada insanların yaşam sürelerinin uzayarak 2019 yılı için 72,6, 2050 yılı için ise 77,1 yıl olması beklenmektedir. Türkiye’de 65 yaş ve üzerindeki nüfusun, toplam nüfus içerisinde oranının 2023'de % 10,2, 2040'da %16,3, 2060'da %22,6 olacağı öngörülmektedir. Bu sebeple 65 yaş ve üzeri gruba yönelik işlemler büyük öneme sahiptir. Altmış beş yaş üstü kişilerden, hukuki işlemler için ilgili dairelerden (noter, tapu) rutin olarak sağlık raporu (akli meleke) istenmektedir. Bu bireyler, bu raporlar için ilk olarak sağlık sisteminin giriş kapısı olan aile sağlığı merkezlerine başvuruda bulunmaktadır. Sağlık raporu düzenleme konusunda hekimlere yetki ve sorumluluklar verilmiştir. Altmış beş yaş üzerindeki bireylerin tümünden hukuki işlemler için sağlık raporu istenmesi, kişinin özerkliğini ihlal eden ve yeterliliğini sorgulamaya açan, olumsuz sonuçlara sebep olabilecek bir uygulamadır. Bu durum iş yükü fazla olan başta aile hekimleri olmak üzere, diğer uzman hekimlerin iş yükünü arttırmakta ve ekonomik olarak devlete külfet doğurmaktadır. Yasal mevzuatta 65 yaş ve üzeri kişilere yönelik hukuki işlem gerçekleştirmede zorunlu bir sağlık raporu düzenlemesi bulunmamaktadır. Buna rağmen hala geriatrik bireylerden rutin olarak bu rapor istenmektedir. Sağlık Bakanlığı ve Adalet Bakanlığı’nın ilgili konuda noterlere ve tapu dairelerine eğitim vermesi, kılavuzlar geliştirmesi ve yaptırımlar uygulaması bu durumun düzelmesi için büyük öneme sahiptir.
